These Terms of Service ("Terms") govern your use of the PositionGuard mobile application ("the App") operated by ScaleForge AI LLC ("we", "us", or "our"). By downloading, installing, or using the App, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use PositionGuard. If you are under 18, you must have permission from a parent or legal guardian. By using the App, you represent that you meet these requirements.

2. Account Registration

You must register with a valid phone number to use the App. You are responsible for maintaining the security of your account and for all activity that occurs under your account. You agree to provide accurate information during registration.

3. Acceptable Use

You agree to use PositionGuard only for lawful purposes. You may not:

• Use the App to stalk, harass, or monitor anyone without their knowledge and consent
• Add someone to a group without their voluntary acceptance of the invitation
• Attempt to access another user's location data outside of the App's intended functionality
• Use the App to facilitate any illegal activity
• Reverse engineer, decompile, or attempt to extract the source code of the App
• Interfere with or disrupt the App's infrastructure or other users' experience
• Create multiple accounts for deceptive purposes
• Use the App's data or APIs for commercial purposes without a separate agreement

4. Location Sharing and Consent

PositionGuard is a location-sharing service that requires mutual consent. By joining a group, you consent to sharing your location with other group members according to the group's settings and your personal privacy preferences. You may stop sharing your location at any time by turning off visibility or leaving the group.

Group owners manage group settings including area definitions and privacy options. Group owners agree not to use these capabilities to monitor members without their awareness.

5. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using the App, you consent to the practices described in the Privacy Policy.

6. Intellectual Property

The App, including its design, features, code, and content, is owned by ScaleForge AI LLC and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

7. Subscriptions and Payments

PositionGuard may offer free and paid subscription tiers. Paid subscriptions are billed through Apple's App Store. Subscription terms, pricing, and renewal policies are presented at the time of purchase. You may manage or cancel your subscription through your device's App Store settings.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the App will be uninterrupted, error-free, or that location data will be perfectly accurate. Location accuracy depends on your device's GPS capabilities and environmental factors.

PositionGuard is not intended for use as a safety or emergency service. Do not rely on the App for critical safety decisions.

9. Limitation of Liability

To the fullest extent permitted by law, ScaleForge AI LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App. Our total liability shall not exceed the amount you paid for the App in the twelve months preceding the claim.

10. Termination

We may suspend or terminate your access to the App at any time for violation of these Terms or for any reason at our discretion. You may stop using the App at any time. Upon termination, your right to use the App ceases immediately.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App or via email. Continued use of the App after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of Washington, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of King County, Washington.
